State of Emergency- Not Extended

The Ethiopian government issued a State of Emergency due to Covid 19 namely Proclamation No 3/2020 to last for five months beginning on April 08,2020. To execute the proclamation the Council of Ministers has issued a Regulation No 466/2020 effective from 11th of April 2020 lasting till the Proclamation remains in force. On Article 3(19) of the Regulation, termination of employment contract of workers administered under Proclamation no 1156/2019 are prohibited except in accordance with protocols established by the Ministry of Social and Labor Affairs (MoLSA). The Ministerial Committee issued a directive no 2/2020 and on Article 23(11) it requires employers to get MoLSA’s approval before terminating an employment contract of an employee.
The State of Emergency Proclamation shall come to an end on September 09, 2020. As a result he penalties, prohibitions and duties imposed by the Proclamation and Regulation will expire. The temporarily suspended regular laws shall be applicable. In the case at hand, employers will not be required to seek approval to terminate employment contracts to MoLSA.
